We are increasingly experiencing situations where clients negotiate deals with third parties with whom they have had a vehicle accident.
THE PROBLEM
For instance: Joe Soap drives into a Barker client and they both agree to claim through their respective insurance companies. Joe Soap then commits to paying the Barker client his excess on the side. The problem arises when the Barker client may in fact be eligible for a full recovery and arranging payment of the excess will only jeopardise the recovery process.
WHAT TO DO IN THESE SITUATIONS
If you are in an accident with a third party, please take their details along with photos, where possible, and send all the necessary information to Barker. That’s all we need from you!
Please do not negotiate settlement of the excess with the third party and do not apologise or admit liability as this may further hinder the claims and recovery process.
